Welcome to FlotillaMate. These Terms of Use ("Terms") govern your use of the FlotillaMate application and website (the "Service"), operated by [COMPANY LEGAL NAME]. By creating an account or using the Service, you agree to these Terms.

1. What FlotillaMate Is

FlotillaMate is a coordination and communication tool for boaters. It helps boaters discover others who plan to travel a similar route around the same time, and communicate about traveling together.

2. What FlotillaMate Is NOT

FlotillaMate is NOT, and must not be relied upon as, any of the following:

A navigation system

A marine chart or charting replacement

A weather service or weather authority

An emergency, rescue, or search-and-rescue service

A towing or salvage service

A captain-for-hire or crewing service

An insurance product

A guarantee that another boat will travel with you

A guarantee of safety, seaworthiness, legal compliance, or successful arrival

3. Your Responsibilities as a Captain

You are solely and fully responsible, at all times, for:

Your own vessel and its condition and seaworthiness

Fuel planning and reserves

Route planning

Checking marine weather and sea conditions

Use of official, up-to-date charts

All navigation decisions

Required and recommended safety equipment

Filing a float plan

A working VHF radio

An EPIRB, PLB, or other emergency device

The safety of all passengers and crew

Customs, immigration, and documentation requirements

Compliance with all local, state, federal, international, and maritime laws

Deciding whether a trip is safe to begin, continue, or abort

4. Assumption of Risk

Boating is inherently dangerous. Weather, sea state, equipment, and other vessels are unpredictable. You knowingly and voluntarily assume all risks associated with boating and with coordinating or traveling near other boaters found through the Service, including risk of property damage, injury, or death.

Any coordination with another user is between you and that user. FlotillaMate is not a party to, and is not responsible for, any interaction, agreement, or trip between users.

5. Limitation of Liability

To the maximum extent permitted by law, [COMPANY LEGAL NAME], its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of life, personal injury, property damage, loss of use, or loss of data, arising out of or related to your use of the Service.

6. User Conduct and Prohibited Activity

You agree that you will not:

Post false, misleading, or fake trips or vessel information

Impersonate any person or misrepresent your identity, experience, or vessel

Harass, threaten, abuse, or endanger other users

Misuse, scrape, or improperly share other users' information

Use the Service for any illegal activity, including smuggling or unlawful transport

Rely on the Service as a safety, navigation, or emergency system

Interfere with, disrupt, or attempt to gain unauthorized access to the Service

7. Account Termination

FlotillaMate may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any conduct we determine to be harmful to other users or the Service.

8. Changes to the Service and Terms

FlotillaMate may update, modify, suspend, or discontinue the Service or these Terms at any time. Continued use after changes take effect constitutes acceptance of the updated Terms.
